Divorce is never pleasant, but unfortunately things sometimes get nasty, especially when people start dragging their kids in the whole ordeal. Actress and singer Hilary Duff has been going through a nasty divorce, and it just got nastier. Duff’s estranged husband Mike Comrie is seeking joint custody of their 3-year-old son Luca! Comrie made his move after Duff filed for primary custody of their son.

The former couple is sticking to their prenups to sort their assets, which makes their adorable son Luca the only point of contention for the couple.

The famed actress and singer wants primary custody of her son because she’s concerned about her ex’s behavior.

To remind you, Comrie caused a scene in a Beverly Hills establishment, when he hit on a waitress and literally threw money on her, demanding sex.

The Lizzie McGuire actress filed for divorce the next day. At the time, a source close to the former child star revealed that she finally realized that Comrie wasn’t going to change: “He totally blew it and chose to live life like he was single.”

Although that may be enough to trigger some trash-talk with certain people, Duff kept acting respectfully and only had nice things to say about her ex since filing for divorce in February. In a recent interview, Duff said: “It wasn’t working well enough to stay together, but there was still a lot of love involved. It was just a slow set-in of us not being the match that we used to be. I’m lucky for the person he is and I am and how we decided to handle this.”

Hopefully, the couple will decide on whatever’s best for their beloved son.
