“There is a contract and he can’t do anything”, Vergara explained. During their relationship, Vergara and Loeb froze fertilized embryos in case they wanted to have children down the road. Now they are no longer together, but Loeb sees this as his opportunity to be a father, comparing his situation to that of two women who “won appeals to bring a frozen embryo to term against the wishes of an ex—partner”.
Vergara’s and Loeb’s contract clearly stipulates that their embryos cannot be implanted in a surrogate unless both parties agree to it, and clearly, Vergara strongly disagrees. She has since moved on with a new fiancé Joe Manganiello and is busy planning a wedding.
